a group of nonwhite cannery workers filed suit in district court citing title vii of civil rights act of 1964 complaining wards cove packing company, company operated several alaskan salmon canneries, using discriminatory hiring practices resulted in large number of skilled permanent jobs did not involve working in cannery (referred noncannery positions) filled white workers, , large number of unskilled seasonal cannery jobs filled local nonwhite workers. in case nonwhite workers predominantly native alaskans , filipinos (alaskeros). district court found in favor of company.
the workers appealed united states court of appeals ninth circuit, reversed district court decision, stating workers had made prima facie case of disparate impact. decision based on statistics provided workers showed high percentage of nonwhite workers in cannery jobs , low percentage of skilled noncannery jobs filled nonwhite workers.
