in 1988, u.s. congressman samuel s. stratton of new york s 23rd congressional district announced withdrawal race due health issues. mcnulty selected replace him on ballot. elected handily in 1 of few reliably democratic areas in upstate new york. reelected 9 more times without serious difficulty. district renumbered 21st district after 1990 census.


in 2004, challenged republican/libertarian warren redlich, later run governor in 2010. mcnulty faced redlich again in 2006, , reelected 78% of vote - widest margin. [1]. had primary challenge in 1996 lee h. wasserman, in won closer margin ever had in general election.

mcnulty presided on vote recommit agricultural appropriations bill on night of august 2, 2007 have prevented illegal immigrants receiving food stamps. mcnulty claimed vote tied 214-214 members changing votes after time had expired, mcnulty gaveled down vote , tallied 212-216 against motion, while republicans argued house screen tally vote 215-213 in favor recommit. republicans chanted shame , later walked out of house in protest. mcnulty , steny hoyer apologized on floor next morning prematurely gaveling down vote. in may 2008, bipartisan investigation panel including bill delahunt , mike pence began working determine whether vote had been tallied correctly , action should taken, if any. year later, panel found democrats did indeed improperly tally vote.
